Calorie Snap

Terms of Use

These Terms are a legal agreement between you and us governing your use of the Calorie Snap: AI Food Log app. By downloading or using the app, you accept these Terms and our Privacy Policy.

Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to use the App. The fasting features are for people aged 18 and over. By using the App you confirm that you meet this age and that you are legally able to enter into this agreement.

What the App does — and does not do

The App lets you log meals by photo or manual entry, uses artificial intelligence to identify the food in a photo, estimates its calorie and macronutrient content, and tracks your intake against a target you set.

AI estimates. An AI model identifies the foods, their ingredients and the portion size from a photo; calorie and macronutrient values are then calculated from that using nutrition reference data. They are estimates, not measurements. They can be wrong — sometimes significantly — depending on lighting, angle, hidden ingredients, portion size, and preparation. Always check the result, and edit it if it looks off. The confidence indicator shows how sure the model is; a high confidence does not guarantee accuracy.

Not medical advice. The App provides general wellness information for adults. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition. Nothing in the App is medical, nutritional, or dietary advice. Consult a qualified healthcare professional before starting any diet, changing your calorie intake, or if you have (or think you may have) a medical condition, are pregnant or breastfeeding, or take medication that interacts with diet.

Calorie targets. Targets are calculated from a standard formula using the data you enter. They are generic starting points, not personalised prescriptions. If you have a history of disordered eating, please do not use calorie-tracking apps without professional support. Help is available; in the US you can contact the National Alliance for Eating Disorders helpline, and in other countries your national health service.

Your account

The App creates an anonymous account on your device on first launch. You are responsible for the device on which the App is installed. You can delete your account and all data at any time in Settings → Account → Delete Account. We may suspend or delete accounts that violate these Terms or that are used to abuse the service.

License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions (including Family Sharing where the subscription allows it). This license does not permit you to use the App on devices you do not own or control, or to distribute or make it available over a network where it could be used by multiple devices at the same time.

Acceptable use

You agree not to:

  • reverse engineer, decompile, or extract the source code, models, prompts, or bundled nutrition database of the App, except where the law expressly allows;
  • scrape, harvest, or bulk-export the nutrition database, presets, or recognition results, or use automated tools or scripts against our servers;
  • circumvent scan limits, subscription checks, rate limits, or other technical protections;
  • upload content that is illegal, that infringes someone else's rights, or that is not a genuine attempt to log a meal;
  • use the App for any commercial purpose, or to build a competing product or dataset;
  • interfere with the operation or security of the App or our servers.

These restrictions do not limit any rights you have under the licenses of the third-party data described in section 07, including the Open Database License for Open Food Facts data.

We may rate-limit, restrict, or terminate access for abuse without notice.

Your content

You own the photos you take and the entries you make. You grant us a worldwide, non-exclusive, royalty-free license to store, copy, process, transmit to our processors (including Google's Gemini API), and display your content solely to provide the service to you, as described in the Privacy Policy. This license ends when you delete the content or your account, except for copies that our processors retain for the limited periods stated in the Privacy Policy.

We do not use your photos or entries to train machine-learning models. If we ever wish to, we will ask for your separate, optional consent.

Our intellectual property

The App, its design, code, recognition pipeline, prompts, nutrition database and presets, trademarks (including "Calorie Snap"), and all related content are owned by us or our licensors and protected by copyright, trademark, and other laws, except for the third-party nutrition data credited below, which remains under its own license. No rights are granted except the license in section 04 and, for that third-party data, the licenses below.

Nutrition data sources. The App's built-in nutrition database includes data from USDA FoodData Central, which is in the public domain, and from Open Food Facts (opens in a new tab), which is made available under the Open Database License (ODbL) (opens in a new tab); individual contents of the Open Food Facts database are licensed under the Database Contents License. Open Food Facts data © Open Food Facts contributors.

Free tier and subscriptions

The App includes a limited number of free photo scans (5). Further scans require a paid auto-renewing subscription purchased through Apple. Manual meal entry remains available without a subscription. See the Subscription Terms for pricing, renewal, cancellation, and refunds.

Availability and changes

We may modify, suspend, or discontinue any part of the App at any time. The App depends on third-party services (including Google, Apple, and hosting providers) that may be unavailable. We will try to give notice of significant changes but are not obliged to.

Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that nutrition estimates are accurate, that the App will meet your goals, or that it will be error-free or uninterrupted.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the App, or from reliance on any estimate it produces. Our total liability for all claims relating to the App in any 12-month period is limited to the amount you paid us for the App in that period, or USD 50, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or — for consumers in the EU, UK, and other jurisdictions with mandatory consumer protection — your statutory rights.

Indemnity

You will indemnify us against claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

Apple-specific terms (required by Apple)

These terms apply because the App is distributed through the Apple App Store.

  1. Parties. This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
  2. Scope of license. The license in section 04 is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of such claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints, or claims regarding the App: Illia Kyselov, sole proprietor (FOP), Kyiv, Ukraine, support@calsn.app.
  9. Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.

Termination

You may stop using the App at any time and delete your account in Settings. We may terminate or suspend your access if you breach these Terms. Sections 06 (as to retained copies), 07, 10, 11, 12, 13, and 15 survive termination.

Governing law and disputes

These Terms are governed by the laws of Ukraine. Disputes will be resolved in the courts of Kyiv, Ukraine.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction that grants you mandatory protections, nothing in this Section deprives you of the protection of the mandatory laws of the country where you live, or of the right to bring proceedings in the courts of that country. EU consumers may also use the European Commission's online dispute resolution platform.

General

These Terms, the Privacy Policy, and the Subscription Terms are the entire agreement between you and us about the App. If any provision is unenforceable, the rest remains in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets. We may update these Terms; material changes will be announced in the App, and continued use after the effective date means acceptance. The English version prevails over any translation.
